The introduction of the Workplace Fairness (Dispute Resolution) Bill, which was passed in Parliament on November 4, 2025, and the passing of the Workplace Fairness Act (WFA) in January 2025 represent a landmark move to strengthen protection against ageism and other forms of discrimination in Singapore’s workplaces.
These landmark laws are slated to take effect from end-2027, a lead time designed to ensure “ample preparation is critical for successful implementation” for both employers and workers.
WFA Strengthens the Fight Against Ageism and Ensures Fair Access to Justice
With Singapore set to become a super-aged society in 2026 , concerns about ageism in “hiring, training and promotion” remain salient for senior workers. The WFA directly prohibits discrimination based on protected characteristics, including age.
The Dispute Resolution Bill establishes a framework providing workers with an accessible and expedited avenue for redress. NTUC Deputy Secretary-General and Senior Minister of State, Mr. Desmond Tan, noted that this provides a “trusted and accessible avenue for redress, giving them confidence and dignity at work”.
From Discrimination to Compensation: How Unions Step In
While the new laws provide a crucial legal safety net, the labour movement, plays a vital role in obtaining fair and early resolution. Mr. Tan shared real-life examples that illustrate the need for these stronger protections, acknowledging that age discrimination is often “subtle and difficult to detect”:
- Wrongful Dismissal Case for a PME:
As Executive Secretary of the Singapore Industrial & Services Employees’ Union (SISEU), Mr. Tan recounted a wrongful dismissal case involving a PME in his mid-40s, who was terminated with one month’s notice despite a satisfactory performance record. Through union mediation, he successfully secured approximately S$55,000 in compensation. - Forced Resignation of Seniors:
He also shared a case where a company asked employees nearing retirement age to resign voluntarily or risk losing medical benefits, only to replace them with new, younger hires. With union intervention, the company recognised the violation and took corrective action.
Mr. Tan highlighted that the Bill provides senior workers with “stronger protection, along with better access to union representation through the expanded claims framework”. This legislation, he emphasised, puts the principle of “protection for a man’s right to his own dignity” into action, a sentiment first expressed by Mr. Lee Kuan Yew.
Legislation Alone Cannot End Ageism; We Must Build Inclusive Workplaces in the AI Era
While the new laws are a significant step, Mr. Tan stressed that fighting ageism is not just about fairness—it is an “economic imperative”.
The focus must extend beyond legal compliance to fostering inclusive environments, especially as the workplace becomes increasingly digital:
- Guarding Against AI Bias:
A major emerging risk is the potential for algorithmic discrimination. Mr. Tan warned that as recruitment becomes more digitised, Singapore must “guard against age bias in AI-based hiring tools”. Automated filters can “unintentionally screen out older applicants if algorithms are trained on biased data”. - A Call for Stronger Governance:
To tackle this, NTUC is asking for “stronger guidance and governance standards for AI-powered HR systems”. This involves working with tripartite partners to develop fair hiring standards and equipping HR practitioners to “detect and mitigate algorithmic bias”. - Beyond Legal Protections:
The focus must be to “build workplace cultures that respect and empower workers of all ages where experience is seen as an asset, not a liability”. This commitment is a key priority for tripartite partners under the Tripartite Workgroup on Senior Employment.
With the workplace fairness laws set to take effect by the end of 2027, both the Government and tripartite partners will continue education efforts, providing “practical guidance through templates, advisories and workshops” to help stakeholders prepare for the new requirements.
